When you use My Positivity Matters Services, we understand that you’re trusting us with your data and we have a responsibility to respect your privacy. We take that responsibility seriously. This policy explains what information we collect, why we do so, whom we share it with, and how we protect it. This policy also provides tools you can use to manage your privacy, including opting out of certain uses of your Personal Information (defined below).
We offer personalized workshops and programs we know that everyone’s usage is different and reflects their personal and/or professional experience. We use the information you give us, together with information we generate and information from other sources, to provide and optimize our services to you. We carefully evaluate how we use data to make sure that we’re using your information to provide value for you.
We do not sell user data.
Information collected by us
When you use our Site and Services, we collect a variety of information from and about you and your devices. Some of this information identifies you directly (like an email address) while some of it is associated with you through.
- Confidentiality: Subject to the terms and conditions herein, only the Client is being granted access to the Program, and during the Program, the Client will be exposed to the Service Providers proprietary and/or confidential information including but not limited to, Materials (whether in electronic form or made available to the Client in private social media groups, or otherwise), documentation, techniques, formulas, methods, processes, algorithms, uses, notes, trade and service marks, trade secrets, images, video, audio, intellectual property, coach information, assessments, evaluation results, other client details, or any login member credentials. (collectively “Confidential Information”). Unless specifically and expressly authorized by this Agreement, the Client shall not use, teach, sell, disclose, reveal, provide, or make available to any third party any of the Service Provider’s Confidential Information. The Client warrant, represent, and agree to (i) hold the Confidential Information in trust and confidence and avoid the disclosure or release thereof to any other person or entity by using the same degree of care as the Client use to avoid unauthorized use, disclosure, or dissemination of the Client’s own confidential information of a similar nature, but not less than reasonable care; and (ii) not use the Confidential Information for any purpose whatsoever except as expressly contemplated under this Agreement. The Service Provider (or its licensor) shall at all times retain all rights, ownership, title, and interest in any Confidential Information. The Client agrees to keep all information provided by the Service Provider confidential during and perpetually after the Term of this Agreement.
- Intellectual Property Rights: The Service Provider owns the Intellectual Property Rights (“IPR”) related to the Material provided by the Service Provider to the Client. The Client acknowledges and agrees that the Program, the names, and logos and all related product and names, design marks and slogans, and all other material or other Confidential Information provided to the Client by the Service Provider during the Program, are the property of the Service Provider or its affiliates (collectively, the “Intellectual Property”). Unless stated otherwise, all Intellectual Properties are protected as the copyright, trade dress, trademarks, and/or other intellectual properties owned by the Service Provider or by other parties that have licensed their material to the Service Provider. The Client is not authorized to use any of the Intellectual Property in any advertising, publicity, or any other commercial manner without the prior written consent of the Service Provider. The Client shall not license, use, sell or assert any rights in the Intellectual Property. The Client’s enrollment into the Program confers no title or ownership in the Program or the Intellectual Property and is not a sale of any rights in the Program or the Intellectual Property. All ownership rights remain in the Service Provider or its third-party suppliers, as the case may be.
